Sarat inregistrat sub nr.2057\/14.01.2020 in conformitate cu prevederile art.136, alin.(8), lit.b) din O.U.G nr.57\/2019 privind Codul administrativ;<\/p>\n<p>&#8211; avizul comisiei\/comisiilor de specialitate a\/ale Consiliului local;<\/p>\n<p>-prevederile art.8, alin.(7) din Legea nr.152\/1998 privind \u00eenfiin\u021barea Agen\u021biei Na\u021bionale pentru Locuin\u021be, republicata, actualizata;<\/p>\n<p>-prevederile H.G 962\/2001 privind aprobarea Normelor metodologice pentru punerea \u00een aplicare a prevederilor &lt;LLNK 11998\u00c2\u00a0\u00c2\u00a0 152 10 201\u00c2\u00a0\u00c2\u00a0 0 18&gt;Legii nr. 152\/1998 privind \u00eenfiin\u021barea Agen\u021biei Na\u021bionale pentru Locuin\u021be;<\/p>\n<p>-prevederile Legii nr.221\/2015 privind aprobarea &lt;LLNK 12014\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0 6130 301\u00c2\u00a0\u00c2\u00a0 0 32&gt;Ordonan\u021bei Guvernului nr. 6\/2014 pentru modificarea \u0219i completarea &lt;LLNK 11998\u00c2\u00a0\u00c2\u00a0 152 11 212\u00c2\u00a0 10 30&gt;art. 10 din Legea nr. 152\/1998 privind \u00eenfiin\u021barea Agen\u021biei Na\u021bionale pentru Locuin\u021be;<\/p>\n<p>&#8211; prevederile O.U.G nr.30\/2017 pentru \u00c2\u00a0modificarea \u0219i completarea &lt;LLNK 11998\u00c2\u00a0\u00c2\u00a0 152 13 2&lt;1\u00c2\u00a0\u00c2\u00a0 0 18&gt;Legii nr. 152\/1998 privind \u00eenfiin\u021barea Agen\u021biei Na\u021bionale pentru Locuin\u021be;<\/p>\n<p>&#8211; prevederile H.G nr. 304\/05.05.2017 privind modificarea \u0219i completarea &lt;LLNK 12001\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0 0112 3V1\u00c2\u00a0\u00c2\u00a0 1 21&gt;Normelor metodologice pentru punerea \u00een aplicare a prevederilor &lt;LLNK 11998\u00c2\u00a0\u00c2\u00a0 152 13 2&lt;1\u00c2\u00a0\u00c2\u00a0 1 18&gt;Legii nr. 152\/1998 privind \u00eenfiin\u021barea Agen\u021biei Na\u021bionale pentru Locuin\u021be, aprobate prin &lt;LLNK 12001\u00c2\u00a0\u00c2\u00a0 962 22 3:1\u00c2\u00a0\u00c2\u00a0 1 33&gt;Hot\u0103r\u00e2rea Guvernului nr. 962\/2001;<\/p>\n<p>&#8211; prevederile Anexei 16 la\u00c2\u00a0 Normele metodologice pentru punerea \u00een aplicare a Legii nr. 152\/1998, privind \u00eenfiin\u021barea Agen\u021biei Na\u021bionale pentru Locuin\u021be, cu modific\u0103rile \u0219i complet\u0103rile ulterioare;<\/p>\n<p>&#8211; prevederile Ordinului Ministerului Dezvoltarii Regionale si Administratiei Publice nr.2097\/2019 pentru stabilirea valorii de \u00eenlocuire pe metru p\u0103trat, pentru anul 2019, \u00een vederea v\u00e2nz\u0103rii locuin\u021belor pentru tineri;<\/p>\n<p>-prevederile Legii nr.278\/2017 privind aprobarea &lt;LLNK 12017\u00c2\u00a0\u00c2\u00a0\u00c2\u00a0 28130 301\u00c2\u00a0\u00c2\u00a0 0 33&gt;Ordonan\u021bei Guvernului nr. 28\/2017 pentru completarea &lt;LLNK 11998\u00c2\u00a0\u00c2\u00a0 152 13 2&gt;2\u00c2\u00a0\u00c2\u00a0 6 29&gt;art. 6 din Legea nr. 152\/1998 privind \u00eenfiin\u021barea Agen\u021biei Na\u021bionale pentru Locuin\u021be, precum \u0219i pentru stabilirea unor m\u0103suri de aplicare a acesteia;<\/p>\n<p>&#8211; comunicatul de presa al Institutului National de Statistica nr.15 din 14.01.2020 care precizeaza ca rata inflatiei determinata pe baza indicelui preturilor de consum in ultimele 12 luni (ianuarie 2019-decembrie 2019) fata de precedentele 12 luni (ianuarie 2018- decembrie 2018) este de <strong>3,8%;<\/strong><\/p>\n<p>&#8211; prevederile HCL nr.300\/28.11.2019 privind alegerea presedintelui de sedinta al\u00c2\u00a0 Consiliului local al Municipiului Rm.Sarat pentru sedintele din lunile decembrie 2019&#8243;\u201c februarie 2020;<\/p>\n<p>-prevederile art.5, lit.m) si n), art.129, alin.(2), lit.d), alin.(7), lit.q) coroborat cu prevederile art.240 din Ordonanta de Urgenta a Guvernului nr.57\/2019 privind Codul administrativ;<\/p>\n<p>Luand in considerare dispozitiile Legii nr.24\/2000 privind normele de tehnica legislativa la elaborarea actelor normative republicata, cu modificarile si completarile ulterioare;<\/p>\n<p>\u00cen temeiul art.133, alin.(1), art. 139, alin.(1) si alin.(3), lit.c) si ale art.196, alin.1, lit.a) din Ordonanta de Urgenta a Guvernului nr.57\/2019 privind Codul administrativ;<\/p>\n<p><strong>\u00c2\u00a0<\/strong><\/p>\n<p><strong>HOT<\/strong><strong>\u00c4\u201a<\/strong><strong>R<\/strong><strong>\u00c4\u201a<\/strong><strong>\u00c5\u017e<\/strong><strong>TE:<\/strong><\/p>\n<p>Art.1. Se aproba recalcularea valorii chiriei lunare aferenta locuintelor pentru tineri, destinate inchirierii, situate in Municipiul Rm.Sarat, strada Industriei nr.2 (ANL 1), calcul diferentiat in functie de pragul de varsta de 35 ani, de rangul localitatii, de ponderea in functie de venitul net realizat pe membru de familie, de anul receptiei locuintei si de cota autorit\u0103\u021bii publice locale (%) din valoarea de inlocuire anuala\/mp a constructiei, conform anexei nr.1, care face parte integranta din prezenta hotarare.<\/p>\n<p>Art.2. Se aproba recalcularea valorii chiriei lunare aferenta locuintelor pentru tineri, destinate inchirierii, situate in Municipiul Rm.Sarat, strada Industriei nr.4 (ANL 2), calcul diferentiat in functie de pragul de varsta de 35 ani, de rangul localitatii, de ponderea in functie de venitul net realizat pe membru de familie, de anul receptiei locuintei si de cota autorit\u0103\u021bii publice locale (%) din valoarea de inlocuire anuala\/mp a constructiei, conform anexei nr.2, care face parte integranta din prezenta hotarare.<\/p>\n<p>Art.3.\u00c2\u00a0\u00c2\u00a0 Se aproba cota autorit\u0103\u021bii publice locale (%), aplicabila titularilor de contracte care au \u00eemplinit v\u00e2rsta de 35 ani, la valoarea de inlocuire a constructiilor &#8211; locuinte pentru tineri destinate inchirierii realizate de Agentia Nationala pentru Locuinte in Municipiul Rm.Sarat de 0,5%.<\/p>\n<p>Art.4. Se aproba prelungirea prin acte aditionale a valabilitatii contractelor de inchiriere care au incetat la data de 31.12.2019, pe o durata de 1 an, pana la 31.12.2020.<\/p>\n<p>Art.5. (1) Chiria lunara pentru contractele de inchiriere aflate in perioada de valabilitate se actualizeaza cu rata inflatiei de 3,8%, titularii contractelor de inchiriere avand obligatia de a transmite administratorilor locuintelor veniturile nete pe membru de familie realizate in ultimele 12 luni.<\/p>\n<p>(2) In situatia in care titularii contractelor de inchiriere nu prezinta documente din care sa rezulte venitul mediu net lunar pe membru de familie, in termenul stabilit de administratorii locuintelor, in vederea calcularii cuantumului chiriei sau in vederea actualizarii anuale a acesteia, chiria se va calcula fara a fi ponderata cu coeficientii aferenti, conform prevederilor art.8, alin.(9^3) din Legea nr.152\/1998 privind \u00eenfiin\u021barea Agen\u021biei Na\u021bionale pentru Locuin\u021be, republicata, actualizata.<\/p>\n<p><strong>Art.6. <\/strong>Se imputerniceste primarul Municipiului Rm.Sarat pentru a semna actele aditionale la contractele de inchiriere aferente locuintelor pentru tineri, avand ca obiect prevederile prezentei hotarari, respectiv Directorul Administratiei Domeniului Public Rm.Sarat, potrivit dreptului de administrare statuat prin acte administrative anterioare.<\/p>\n<p><strong>Art.7.<\/strong> Incepand cu data prezentei hotarari orice alta dispozitie contrara isi inceteaza aplicabilitatea.<\/p>\n<p>Art.8. Cu aducerea la \u00eendeplinire a prezentei hotarari se insarcineaza \u00c2\u00a0Primarul municipiului Rm.Sarat prin Directia economica, Serviciul Urbanism -Compartiment Spatiu Locativ si Compartimentul Contencios Administrativ si Juridic din cadrul aparatului de specialitate al primarului municipiului Rm. Sarat \u00c2\u00a0precum si persoanele abilitate sa exercite controlul financiar preventiv propriu, respectiv auditul public intern, operatiuni ce se exercita asupra tuturor opera\u021biunilor care afecteaz\u0103 fondurile publice locale \u0219i\/sau patrimoniul public \u0219i privat, conform reglementarilor legale \u00een domeniu, de catre functionarii publici din cadrul aparatului de specialitate al primarului abilitati in acest sens, respectiv Administratia Domeniului Public Rm.Sarat, in stransa corelare cu raspunderea administrativa si cu principiile raspunderii administrative conform competentelor celor implicati in r\u0103spunderea aferent\u0103 actelor administrative.<\/p>\n<p><strong>Art.9.<\/strong> Prezenta hotarare se aduce la cunostinta publica, respectiv se comunica Primarului municipiului Rm. Sarat, celor nominalizati cu ducerea la indeplinire si se comunica Institutiei Prefectului Judetului Buzau in vederea exercitarii controlului cu privire la legalitate.<\/p>\n<p><strong>\u00c2\u00a0<\/strong><strong>Aceast\u0103 hot\u0103r<\/strong><strong>\u00e2<\/strong><strong>re a fost adoptata de catre Consiliul Local al Municipiului Rm. Sarat in sedinta ordinara din data de 30.01.2020, cu respectarea prevederilor art.139 alin.3, lit.c) (majoritate absoluta) din O.U.G nr.57\/2019 privind Codul administrativ, cu un numar de 19 voturi pentru, _____-____ abtineri si ______-___ voturi impotriva din numarul total de 19 consilieri locali in functie si 19 consilieri locali
